Why Seismic Regulation Matters to Azerbaijani Investors in Türkiye

Azerbaijani investors bring a natural fluency in seismic risk to their Turkish real estate decisions. Baku and the wider Absheron peninsula sit in an active seismic zone, and Azerbaijani developers, engineers, and institutional buyers are accustomed to factoring earthquake resistance into project economics. Türkiye's construction market rewards that instinct. Following the February 2023 earthquakes in Kahramanmaraş and neighboring provinces, seismic compliance moved from a background technical issue to a front-line due diligence item for every serious buyer, whether acquiring a completed building, financing new construction, or evaluating a renovation.

The Regulatory Baseline: TBDY 2018

Türkiye's current seismic design code, TBDY 2018 (Türkiye Bina Deprem Yönetmeliği), governs structural requirements for new construction nationwide. It replaced the 2007 code with stricter soil-structure interaction analysis, tighter ductility requirements for reinforced concrete frames, and mandatory site-specific soil surveys (zemin etüdü) before permitting. For Azerbaijani investors used to Baku's own seismic zoning framework, TBDY 2018 will feel procedurally familiar but administratively more fragmented: compliance is enforced through a network of independent building inspection firms (yapı denetim şirketleri), municipal permitting offices, and, for larger projects, structural peer review requirements that vary by province and by building risk classification.

What This Means for Site Selection

Seismic microzonation varies significantly even within a single metropolitan area. Istanbul's European and Anatolian sides carry different fault-line proximities and soil profiles; districts built on reclaimed coastal fill generally carry higher liquefaction risk than those on bedrock further inland. Before committing capital, Azerbaijani buyers should request the district-level microzonation map and soil survey report for any specific parcel, not a generic city-wide risk rating. A property's marketing materials rarely disclose this detail unprompted, so it belongs on the standard due diligence checklist alongside title and zoning verification.

Building Age and Retrofit Status

Türkiye's building stock includes a large volume of structures built before 2000, when code enforcement was materially weaker. For any acquisition involving an existing building, rather than new construction, the seismic due diligence question is not simply "does this comply with current code" but "when was it built, under which code cycle, and has it undergone structural retrofit or urban transformation (kentsel dönüşüm) review." Buildings enrolled in kentsel dönüşüm programs have typically been flagged by municipal authorities as priority candidates for demolition and rebuild, which changes both the risk profile and the investment thesis considerably. An Azerbaijani buyer evaluating an older Istanbul or Izmir property should commission an independent structural assessment rather than relying on the seller's documentation alone.

Insurance as a Diligence Signal

Turkish law requires DASK, the compulsory earthquake insurance pool, for residential title transactions, and commercial properties increasingly carry supplemental private earthquake coverage. Insurers price risk using their own seismic and structural models, so a quote that is unusually difficult to obtain, or priced well outside comparable properties in the same district, is itself a useful (if informal) data point about a building's underlying condition. Azerbaijani investors should treat insurance underwriting as a secondary verification layer alongside the formal engineering report, not a substitute for it.

Practical Steps Before Committing Capital

Three checks reduce seismic exposure meaningfully at the pre-purchase stage: obtaining the soil survey and structural design documentation directly from the contractor or developer rather than a summary; confirming the building inspection firm's registration and independence from the developer, since conflicts of interest in this relationship have been a documented weak point in past enforcement; and, for existing buildings, commissioning a third-party structural condition assessment regardless of the building's stated compliance status.

Seismic due diligence in Türkiye is ultimately a documentation exercise as much as an engineering one. Investors who insist on primary source records, rather than summary assurances, are far better positioned to price risk accurately and to structure contracts that hold contractors and developers accountable for the standards they claim to meet.
