Azerbaijani investors and businesspeople frequently purchase property in Türkiye without being able to travel for every stage of the transaction. A well-drafted power of attorney (POA) allows a trusted representative, whether a lawyer, family member, or advisory firm, to complete title transfer, sign contracts, and handle related formalities on the buyer's behalf. Because Turkish notarial and land registry practice is procedurally strict, getting the POA right the first time avoids costly delays.

Why a Power of Attorney Matters for Azerbaijani Buyers

Title deed (tapu) transfers in Türkiye must be executed in person before the Land Registry Directorate, or by a representative holding a valid, specifically worded POA. For Azerbaijani citizens who cannot remain in Türkiye through closing, or who prefer not to travel at all, the POA is the mechanism that keeps the transaction moving. It is equally useful for buyers acquiring multiple units, since one representative can close several transactions without the principal being physically present each time.

Where to Execute the Document : An Azerbaijani buyer has two practical options. The POA can be signed at a Turkish consulate in Azerbaijan, which issues it directly in the form Turkish authorities expect, or it can be executed before an Azerbaijani notary and then apostilled, since both Türkiye and Azerbaijan are parties to the Hague Apostille Convention. The apostille route is often faster if a Turkish consular appointment is not readily available, but the document must still be translated into Turkish by a sworn translator and notarized locally before use.

Scope and Wording

Turkish notaries and land registry officials will reject a POA that is vague or generic. The document should specify real estate transactions explicitly, including the authority to buy, sell, mortgage, or transfer title, and should reference the ability to represent the principal before the Land Registry Directorate, tax offices, and municipal authorities. If the representative will also open a bank account, apply for a tax identification number, or handle utility connections on the buyer's behalf, each of these powers should be listed individually rather than assumed under a general clause. Purpose-built POAs prepared with input from a Turkish lawyer familiar with land registry requirements tend to move through the system with far fewer objections than templates adapted from other jurisdictions.

Validity and Registration : A POA issued abroad, once apostilled and translated, is generally accepted by Turkish notaries and the land registry without further legalization, since the apostille satisfies the authentication requirement between the two countries. It is good practice to have the Turkish translation itself notarized in Türkiye, even where an apostilled translation was produced in Azerbaijan, since local offices sometimes prefer their own registered translators. There is no fixed national expiry for a POA, but many notaries and banks are cautious about instruments older than one year, so buyers with longer timelines should plan to renew or reissue closer to the actual transaction date.

Choosing and Limiting the Representative's Authority

Because a broadly worded POA grants real legal power over the buyer's assets, the choice of representative deserves the same care as the choice of lawyer or agent. Azerbaijani buyers commonly appoint either a family member resident in Türkiye or a licensed advisory firm that specializes in managing the transaction on the client's behalf. Where the representative is not a close relative, it is prudent to limit the POA to the specific property or transaction type, set a defined expiry date, and require the representative to report each step before signature. Some buyers also choose to grant a special, single-use POA for each closing rather than a standing general authority, which reduces exposure if the document is ever misused.

Revocation : A POA can be revoked at any time by notifying the Turkish notary that issued or registered it, and revocation should be communicated in writing to any bank, land registry office, or counterparty that may still be relying on the original document. Azerbaijani buyers working with an advisory partner on the ground in Türkiye typically find the POA process straightforward, provided the document is drafted with the specific transaction, and the specific authorities, clearly in view from the outset.
