Netherlands Investors: Seismic Safety and Building Codes in Türkiye

Dutch investors evaluating Turkish real estate bring a particular sensitivity to structural risk. The Netherlands builds almost nothing on active fault lines, so Dutch buyers often lack an intuitive reference point for what seismic-resistant construction actually requires, and how to verify it before signing a purchase agreement. In Türkiye, where large parts of the country sit on active seismic zones, that verification step is not optional.

Türkiye's Building Code Since 2018

Türkiye's current seismic design standard, the Turkish Building Earthquake Code (TBDY 2018), sets requirements for structural systems, soil-structure interaction, and reinforcement detailing that are broadly aligned with modern international practice, including Eurocode 8 principles familiar to Dutch engineers. The code applies to new construction and governs how load-bearing systems, foundations, and connections must be designed for the seismic zone of a given plot.

The more important distinction for an investor is not the code itself but its era of application. Buildings completed after 2018, particularly those that received occupancy permits under the revised inspection regime, generally reflect a materially different engineering standard than older stock. Dutch buyers accustomed to a mature, standardized permitting culture at home should treat the construction date and permit history of a Turkish property as a primary due diligence variable, not a secondary detail.

Independent Structural Audits

Why it matters : Türkiye's building inspection system (yapı denetim) assigns private inspection firms to oversee construction quality, but the rigor of that oversight has varied across regions and periods. A structural audit commissioned independently of the seller or developer, ideally by a licensed engineer with no commercial relationship to the transaction, is the most reliable way to confirm that a building's actual construction matches its design documentation.

For Dutch investors used to government-run building inspectorates, the idea of a privately contracted inspection system can feel less authoritative. The practical response is to treat the developer-provided inspection report as a starting point, not a conclusion, and to commission a second, independent structural review before committing capital, particularly for buildings constructed before 2018 or in higher seismic risk zones such as the Marmara region around Istanbul.

Soil Studies and Foundation Design

A soil survey (zemin etüdü) is a mandatory precondition for permitted construction in Türkiye, and it determines the foundation type and depth required for a given site. Soil composition varies significantly across Istanbul and other major cities, and two plots a few hundred meters apart can carry different risk profiles. Dutch investors, coming from a country where soil-related construction risk is dominated by settlement and groundwater rather than seismic amplification, should ask specifically to see the soil report and confirm the foundation design corresponds to its findings, rather than relying on general assurances about the building's location.

Earthquake Insurance as a Practical Signal

Türkiye's compulsory earthquake insurance scheme, DASK, covers residential structures up to a set limit and is a legal requirement for title registration on eligible properties. While DASK coverage itself does not certify structural quality, insurers increasingly require documentation on building age, permit status, and construction type to issue supplementary commercial coverage above the statutory minimum. For larger acquisitions or portfolio purchases, the ease or difficulty of securing adequate supplementary insurance can serve as an informal, market-based signal of a building's underlying structural risk.

Practical Due Diligence Sequence

For Dutch investors, a workable sequence is: confirm the construction permit date and code regime applied, request the original soil survey and structural design documentation, commission an independent structural audit for any pre-2018 asset or high-density seismic zone, and verify the property's DASK status and insurability before finalizing a purchase agreement. This sequence adds time to a transaction but is proportionate to the risk profile of the asset class and consistent with the diligence standards Dutch institutional buyers already apply in other emerging markets.

Seismic risk in Türkiye is manageable and well understood by the local engineering profession, but it requires deliberate verification rather than assumption. Investors who build this diligence into their acquisition process from the outset avoid the far more costly alternative of discovering structural gaps after closing.
